Litigation Claim Financing

Funded where the bank said no — because a lawsuit isn't collateral a bank can underwrite.

A $4M claim doesn't show up on a bank's balance sheet as an asset. It shows up as a question their credit box has no field for. That's not a pricing problem. It's a structural one — and it's the exact gap our private capital network exists to close. We've placed $1M–$100M across 8,000+ private capital sources, and litigation claim financing is one of the categories we quote when the bank, and the broker before us, wouldn't even open a file.

Who this is for

What actually gets these funded

Banks decline this category for a reason that has nothing to do with your case. Their underwriting model needs a fixed maturity, a cash-flowing asset, or a hard collateral value. A pending claim has none of those. It has a probability distribution instead of a balance sheet line, and no bank credit committee is built to price a probability distribution. That's not a judgment on your case. It's a structural mismatch between the asset and the lender.

A private lender needs four things a bank doesn't ask for:

Case strength, assessed by someone who reads cases for a living. Not a guarantee of outcome — nobody in this market offers that, and anyone who does is selling you something. What the lender wants is a defensible read: procedural posture, counsel's track record, and whether the claim has survived the motions that kill weak cases early.

Expected timeline to recovery. A claim six months from trial prices differently than one two years out. Timeline drives structure — advance rate, cost of capital, and how the lender models its own liquidity risk holding the position.

Recourse structure. Most litigation financing is structured non-recourse against the claim itself — the lender's repayment depends on the outcome, not on your personal or business balance sheet. That structure is exactly why the diligence on the claim has to be real. The lender isn't underwriting you. They're underwriting the case.

Counterparty capacity to pay. A won judgment against a defendant with no assets isn't a funded claim. Lenders check whether the other side can actually satisfy a judgment or settlement before they price anything.

None of this is legal advice, and we don't provide any. It's the underwriting logic that separates claims that get funded from claims that get declined by every bank that looked at the file and had nowhere to put it.

What we need from you to start

If your claim has been declined, ignored, or quietly shelved by a bank that couldn't figure out where to file it, that's the starting point, not the end of it. Tell us the real status of the case — the setbacks, the motions that didn't go your way, the reason it's taken longer than expected. That's the information that gets a private lender to yes. Apply and we'll have an underwriter on the phone with you inside one business day, no cost and no credit pull to find out.

This is financing against a legal claim, not legal advice or legal representation. We don't assess or guarantee the outcome of any case. Final terms are underwritten deal-by-deal and set in coordination with your counsel of record.
